Victorian Equal Opportunity Act Exception

BAE Systems Australia Defence Pty Ltd, the main employer at the shipyard at Williamstown in Victoria, has lodged an Application for an exemption under section 89 of the Equal Opportunity Act 2010 (Vic.).

This is to bring BAE Systems Australia Defence Pty Ltd into line with the exemption currently in place for the parent company, BAE Systems Australia Limited. If granted, the exemption will be on the same terms and for the same period as that continuing exemption, until 2 May 2017.

BAE Systems Australia Defence Pty Ltd (the applicant) has applied to the Victorian Civil and Administrative Tribunal (VCAT) for exemption from the Equal Opportunity Act 2010 to discriminate on the grounds of nationality against any member of its Victorian workforce or person wishing to join its Victorian workforce in relation to controlling access to specified technology or technical data for defence-related project undertaken or to be undertaken by it, to the extent required to enable it to comply with its other statutory obligations and its contractual obligations. Further details of the application may be obtained by contacting the applicant or the Tribunal.

If you want to make a submission to the Tribunal either for or against the Application you must send it in writing addressed to Human Right List VCAT 223 William Street, Melbourne VIC 3000. Please quote reference H214/2014.

The closing date for submission is 22 December 2014.
